Environmentally Responsible Redevelopment and Reuse (ER3) Success Story - FMC

In 2010, as part of ER3, EPA entered into a Prospective Lease Agreement (PLA) with Energy Answers International (Energy Answers) to convert the facility into a waste-to-energy generation plant. The PLA allowed Energy Answers to move forward with its purchase of the FMC manufacturing facility located on the Fairfield Peninsula in Baltimore, Maryland . The PLA covered the airspace above the FMC plant and was critical to closing the deal between FMC and Energy Answers. The PLA addressed liability under the Resource Conservation and Recovery Act (RCRA) and the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA, commonly known as the Superfund).

Under Maryland law, municipal solid waste is defined as renewable energy. Energy Answers, which has operates other waste-to-energy facilities in the United States, will convert up to 4,400 tons of municipal solid waste which includes garbage from homes and some businesses in its combined heat and power production. It will also use other types of trash and biomass when available. For example, street and park maintenance, construction and land clearing, and used shipping pallets all yield burnable woody debris. Ruined cars, in the process of being recycled, give up rubber, paper, hard plastic, and vinyl that are combustible. Old tires, ground into chips and co-fired with other fuels, help the mix burn hotter and yield more energy.

Multiple benefits of this plant generating energy from municipal solid waste include:

  • Generate energy from renewable and alternative fuels
  • Increase regional recycling rates
  • Recover valuable materials for commercial reuse
  • Reduce landfilling and associated greenhouse gas emissions
  • Redevelop a "brownfield" site into an Eco-Industrial Park
  • Create over 180 permanent "green collar" jobs and opportunities for hundreds more
  • Create an average of 400 union construction jobs over a 3 year period
  • Provide new industrial services facilities in the neighboring communities to service the Fairfield Renewable Energy Power Plant needs.

The 140 MW combined heat and power plant is designed to provide wholesale energy to help meet regional demands, as well as reduced priced retail energy as an attraction for energy intensive industries to co-locate at an Eco-Industrial Park to be developed on the 90-acre "brownfield" site.

The sustainable redevelopment principles behind ER3 – economic vitality, environmental protection, and recognition of human equity – were the principles driving the PLA allowing the redevelopment project to go forward. EPA – Region 3 worked closely with the Maryland Department of Environment, Energy Answers, and the FMC Corporation to ensure this renewable energy source and its attendant benefits were based on the principles of ER3.
